Acceptable Use Policy

This Acceptable Use Policy sets out the products, services, and activities that must not be sold, promoted, facilitated, or processed using the Metapass Platform or Metapass Commerce, and the steps Metapass Pty Ltd (ABN 19 671 041 937) may take where they are. It applies to all clients and to all authorised users, and forms part of the policies referred to in our client agreements and in the Platform Terms of Use.

1. Prohibited Products and Activities

You must not use the Metapass Platform to sell, promote, facilitate, or process any product, service, or activity that is:

  • unlawful under any applicable state, Commonwealth, or international law;
  • misleading or deceptive;
  • infringing of the intellectual property rights of any person;
  • unsafe;
  • fraudulent;
  • abusive or malicious;
  • prohibited by any Metapass policy in place from time to time; or
  • prohibited by any applicable payment provider, acquirer, card scheme, bank, or third-party service provider.

Card schemes, acquirers, gateways, and payment method providers each maintain their own lists of restricted and prohibited categories. Those restrictions apply to your use of the Metapass Platform in addition to this policy, and they may change without notice to us. It is your responsibility to remain compliant with the requirements of every payment service connected to your account.

2. Platform Conduct

Authorised users must not use the Metapass Platform to impersonate any person or entity, transmit unlawful or offensive material, send messages in contravention of the Spam Act 2003 (Cth), upload malicious code, attempt to gain unauthorised access to systems or networks, interfere with the operation of the platform, or harvest personal information about others.

Authorised users must not reverse engineer, decompile, disassemble, copy, resell, sublicense, or otherwise exploit the Metapass Platform other than as expressly permitted.

The complete conduct obligations are set out in sections 4 and 5 of the Platform Terms of Use.

3. Cardholder Data

You must not collect, store, process, or transmit cardholder data outside the approved Metapass or payment provider flows, unless expressly approved by us in writing and compliant with the Payment Card Industry Data Security Standard (PCI DSS).

4. Merchant Responsibilities

Metapass provides payment orchestration, gateway connectivity, and managed commerce software. Unless expressly agreed in writing, Metapass is not an acquirer, card scheme, bank, stored value facility, issuer, credit provider, remittance provider, financial adviser, payment service provider of record, or holder of client funds.

You are responsible for:

  • maintaining your own merchant facility, acquiring relationship, and payment service provider accounts;
  • complying with all card scheme rules, gateway terms, acquirer terms, payment wallet terms, chargeback and refund rules, fraud monitoring requirements, and payment method requirements that apply to any payment service connected to the Metapass Platform;
  • the accuracy and lawfulness of your product listings, pricing, and store content; and
  • all refunds, chargebacks, reversals, disputes, retrieval requests, fraud claims, negative balances, reserves, and provider fees charged, withheld, or recovered in connection with your transactions.

5. Enforcement

Metapass may refuse, restrict, remove, disable, or suspend access to any product, content, feature, integration, payment method, or part of the Services where Metapass reasonably considers this necessary to comply with:

  • any applicable law;
  • payment provider requirements or card scheme rules;
  • security requirements;
  • intellectual property complaints;
  • fraud prevention and risk controls; or
  • the terms of your agreement with us.

Suspension of access under this policy does not relieve a client of its obligation to pay fees due under its agreement with Metapass. Where the breach is capable of remedy, we will generally give you the opportunity to remedy it, but we may act immediately where the law, a payment provider, a card scheme, or the security of the platform requires it.

6. Reporting a Breach

If you believe a merchant, user, or store using the Metapass Platform is in breach of this policy, please report it to us with as much detail as you can provide.

7. Changes to This Policy

We may update this Acceptable Use Policy from time to time to reflect changes in law, payment provider requirements, card scheme rules, or our services. When we make changes, we will update the "Last updated" date at the top of this page.
